Chaparral Village II is a single-family attached (townhome) community in Scottsdale, AZ. This Declaration of Covenants, Conditions and Restrictions (CC&Rs) establishes rules that run with the land and bind all lot owners, their tenants, and guests. The community has an architectural control authority that must approve most exterior changes, and owners are responsible for maintaining their lots and any common walls with neighbors.
- Residential use only: All lots must be used exclusively as single-family residences. No businesses, trades, or nonresidential uses are allowed.
- Animals & pets: Only a reasonable number of generally recognized house or yard pets are allowed, kept as domestic pets not for commercial purposes. No animal may create excessive noise or nuisance. Animal structures must not be visible from neighboring property. The architectural control authority decides what is a pet and what is reasonable.
- Architectural review: Almost all exterior changes — including buildings, fences, walls, landscaping, color schemes, antennas, window coverings, HVAC, solar panels, and fuel tanks — require prior written approval from the Architectural Control Authority. No reflective window materials are allowed. Changes without approval are prohibited.
- Parking & vehicles: No inoperable, abandoned, or commercial vehicles may be parked visibly from neighboring property. Trucks, trailers, campers, boats, and similar vehicles generally cannot be kept visible without approval, except for certain vehicles under size limits (max 205" length, 75" height, 80" width) and guest vehicles for up to 7 days per 6-month period. Vehicles must be parked in garages or carports whenever possible. No street parking is allowed within the project.
- Leasing & rentals: An owner may lease his entire lot, but all leases must be in writing and must state that the lease is subject to the Declaration. Any lease violation by the tenant is a default under the lease.
- Common walls: Owners sharing a common wall have equal rights to use it, but if one owner damages the wall, that owner must repair it at their own cost. If damage is from other causes, adjoining owners share the repair cost equally. Modifications to a common wall require written consent from the other owner.
- Maintenance & nuisances: Each owner must keep their lot, dwelling, and all improvements in good condition and repair. No rubbish, debris, odor, or nuisance may be created. Exterior speakers, horns, or sound devices (except security devices) are prohibited. Clotheslines and outdoor drying are not allowed. Trash containers must be kept out of sight except during collection.
- Signs: Only one small residential identification sign (up to 36 square inches) per lot and one "for sale" or "for rent" sign (size and placement subject to architectural approval) are allowed. No other signs, including political or commercial, are permitted.
