What Main Street Mews, the Mark's governing documents say
This is a use restriction (a side agreement) between the owners of two adjoining condominium properties in Scottsdale, AZ—Main Street Mews and The Mark. It permanently limits how tall and how dense buildings can be on the Mews Property, for the benefit of The Mark. This is not a full set of homeowners' rules; it only restricts future development.
- Building height limit on Mews Property: No building or structure on Mews Property may exceed three stories (excluding mechanical fixtures, antennas, parapets, and other architectural elements).
- Floor area ratio (density) limit: Development on Mews Property must not exceed the floor area ratios allowed by the zoning ordinance in effect as of November 2009 (attached as Exhibit C).
- Perpetual term: The restriction is perpetual. It can only be amended or terminated by a written agreement signed by each then-owner of both properties (Mews and Mark), unless a condominium declaration allows the association or a subset of owners to act.
- Who can enforce: The restriction may be enforced by the original owner AG Investments, any owner of ten or more condominium units in The Mark, or The Mark's condominium association. Violations can be restrained by court action, and damages may be awarded.
- What this document doesn't cover: This document does not contain any rules about pets, leasing, assessments, parking, or other day-to-day living requirements for either property. It only restricts development of Main Street Mews. For actual homeowners' rules, you would need the respective condominium declarations and bylaws.
