McDowell Shadow Estates III is a planned residential neighborhood of single-family detached homes in Scottsdale, AZ. These Covenants, Conditions and Restrictions (CC&Rs) run with the land and bind all owners, residents, and occupants. The community is governed by a homeowners association (McDowell Shadow Estates III Community Association, Inc.) which manages common areas, enforces rules, and levies assessments.
- Use restrictions: Lots are for single-family residential use only; no commercial activity is allowed. A 'Single Family' is defined as a group of persons related by blood, marriage, or adoption, or a group of not more than three unrelated persons, plus domestic servants, who maintain a common household.
- Architectural review: An Architectural Committee (appointed by the Board) must approve all improvements, alterations, and construction on lots. This includes buildings, fences, walls, landscaping, paint colors, and any visible changes. Committee decisions are binding.
- Assessments & fees: All lot owners must pay annual assessments (initially $490 per lot, adjustable annually by CPI or 5%). Supplemental and special assessments require a 2/3 vote of members. Assessments are a continuing lien on the lot and a personal obligation of the owner.
- Common area use & maintenance: Owners have a non-exclusive right to use common areas (landscape easements, walkways, parking, walls, etc.). The Association maintains common areas; owners maintain their lots and any improvements, including boundary fences shared with neighbors.
- Membership & voting: Every lot owner is a member of the Association. Each lot gets one vote (Class A). Declarant has Class B membership with 10 votes per lot until Class A votes exceed Class B or Declarant relinquishes. Voting rights can be suspended for unpaid assessments or other defaults.
