What Monterey at Mountain View's governing documents say
Monterey at Mountain View is a single-family detached home community in Scottsdale, AZ, governed by an HOA (Monterey at Mountain View Homeowners' Association, Inc.). This Declaration of Covenants, Conditions and Restrictions applies to all lot owners and sets rules on land use, architecture, assessments, rentals, pets, vehicles, and maintenance.
- Use restrictions: Each lot is for single-family residential use only. A single family can be related persons or up to 5 unrelated persons living as a common household. No business, professional, or commercial activity is allowed, except one garage/yard sale per 12-month period. No temporary structures, noxious activities, or nuisances are permitted.
- Architectural review: All buildings, fences, walls, landscaping, exterior alterations, and color changes require prior written approval from the Architectural Control Committee. Applications must include plans, specifications, and details. If the committee does not approve or disapprove within 30 days, approval is deemed granted, provided work follows the submitted plans.
- Assessments & fees: Each lot pays a proportionate share (initially 1/48 per lot, max 89 lots) of assessments for common amenities and administration. For unimproved lots, the maximum annual assessment is $120. For improved lots, the cap increases annually by the greater of CPI or 5%, unless members approve a higher amount by 2/3 vote. Assessments are due quarterly on the 1st of Jan, Apr, Jul, Oct; late payments bear 12% interest and create a lien.
- Leasing & rentals: Only entire living units may be rented, not portions. Leases must be in writing and require the lessee to comply with all governing documents. Owners must notify the association of the lease term and occupant names. Transient or hotel use is prohibited; minimum lease term is not stated, but month-to-month is included in the definition.
- Pets & animals: Only commonly accepted household pets are allowed (no farm animals, horses, poultry, etc.), in reasonable numbers and not for commercial purposes. Pets must be kept indoors or within fenced yards, not allowed to run loose. Structures for animals must not be visible from neighboring property; owners must clean up after pets.
- Parking & vehicles: No boats, RVs, campers, buses, commercial trucks over 3/4 ton, or similar vehicles may be kept on lots. Only off-street paved parking is allowed; on-street parking only for deliveries or short-term guests. All vehicles should be kept in garages if sufficient. Emergency repairs only; no construction or repairs visible from neighboring property.
- Maintenance responsibilities: Owners must maintain the exterior of their living units (walls, roofs, porches, patios, garages) in good repair, keep landscaping trimmed and free of weeds, and keep garage doors closed except for ingress/egress. The association maintains common amenities (defined as real property owned for common use, such as walks, open spaces, and facilities).
