What One Scottsdale's governing documents say
This declaration creates 'One Scottsdale', a large mixed-use master-planned community in Scottsdale, AZ, that may include retail, commercial, residential, hotel, and other uses. It establishes the One Scottsdale Owners' Association (OSOA) to manage common areas, levy assessments, and enforce rules. All property owners within the development are bound by these covenants, which run with the land.
- Community type & governance: One Scottsdale is a master-planned community with a master association (OSOA) and potential sub-associations for residential areas. OSOA handles common area maintenance, insurance, and enforcement. Membership and voting are based on acreage (10 votes per acre), with Declarant retaining control until the Turnover Date (earliest of no Declarant ownership, Dec 31, 2031, or earlier written designation).
- Use restrictions: Prohibited uses include off-track betting, casinos, marijuana businesses, adult establishments, pawn shops, flea markets, tattoo parlors, massage parlors (excluding spas), second-hand stores, and certain going-out-of-business sales. A future sign program will govern signage. One property (HQ Property) is reserved for a corporate headquarters for laundry/personal care/home care products, and no other similar facility may be developed without consent.
- Assessments & fees: Regular Assessments fund operational costs, allocated per Membership (acreage-based). Cost Center Assessments cover amenities or services benefiting only some owners. Special Assessments up to $1M (adjusted for inflation) or 20% of annual budget require 75% owner approval if exceeded. Reimbursement Assessments cover enforcement or repair costs caused by an owner. Late fees and 10% interest (18% for Reimbursement) apply.
- Maintenance responsibilities: Owners must maintain their parcels (including improvements) in good condition per first-class mixed-use standards. OSOA maintains common areas. If an owner fails to maintain, OSOA may step in and charge a Reimbursement Assessment.
- Enforcement & penalties: OSOA can enforce rules through legal action, fines, suspension of voting rights or common area use (except denying access to the parcel), and liens. Notice and hearing are required before most enforcement actions. Delinquency costs (attorney fees, etc.) can be added as Reimbursement Assessments.
- Telecommunications facilities: Installation of telecom facilities (antennas, towers, wiring, etc.) generally requires Declarant or Board approval, except for public utilities under recorded easements or facilities entirely within a building for internal use. Passive revenue from telecom is restricted.
- Reserved developer rights: Declarant retains rights to annex additional property, exempt itself from assessments (with subsidy), approve subdivisions, and control common area improvements until the Turnover Date. Declarant may also establish telecom facilities for passive revenue.
- What this document doesn't cover: This excerpt does not specify age restrictions (though age-qualified areas are mentioned as possible), pet rules, lease duration limits, parking regulations, architectural review procedures, or specific amenity descriptions. Those may appear in later articles or supplemental declarations.
