What Scottsdale Marquessa Condominium Association's governing documents say
Scottsdale Marquessa is a 113-unit condominium in Scottsdale, Arizona — you own your individual unit and share ownership of the building structure, grounds, and shared systems through the association. The association maintains the exterior, common areas, and master building insurance; you maintain your unit's interior, appliances, and exclusive patio/parking.
- What you own & maintain: You own your unit interior, a patio or balcony, one assigned covered parking space, and exterior fixtures serving only your unit (doors, windows, shutters). You maintain all interior finishes, your appliances, unit-specific HVAC/electrical/plumbing, and your exclusive patio and parking area.
- Common elements & association maintenance: The association maintains the building exterior, roof, structural walls, common hallways, landscaping, recreational facilities, parking areas, main utility lines, and common systems. The association carries master insurance and funds maintenance through assessments levied per unit.
- Renovations & alterations: Minor work (paint, cabinets, appliances, some flooring) needs no approval or only Architectural Committee approval; major work (moving walls, electrical/HVAC/plumbing changes, new windows, exterior painting) requires both Architectural Committee and Board approval. Structural changes to common elements need 51% member vote and a licensed professional engineer.
- Leasing & rentals: Leases must run at least 30 consecutive days, and you can lease only once per 12-month period. No more than 20% of all units can be leased to third parties at any time; exceptions include existing owners, family members (parents, children, grandchildren, siblings), and leases that were already in place when this amendment was recorded.
- Pets: Maximum of 2 domestic pets per unit; allowed types are dogs, cats, birds, and fish, each not exceeding 25 pounds. Pets must be leashed (max 6 feet) outside your unit, controlled at all times, and cannot create unreasonable noise or odor. You must immediately remove pet waste from common areas.
- Motor vehicles & parking: No vehicles of any kind can be parked on streets within the project. Motor homes, trailers, campers, boats, and full-size trucks are prohibited; trucks and mini-vans under 205" length, 75" height, and 80" width used for regular transportation are allowed if parked in compliance. No vehicle service or repair visible from neighboring property.
- Architectural & design restrictions: The Architectural Committee must approve antennas, satellite dishes, window coverings (no reflective materials), exterior colors/materials, patio finishes, and exterior signage (limited to 9×30" name/address signs; "For Sale/Rent" signs allowed per rules). Utility lines must be underground or concealed; no outdoor clotheslines or exterior sound devices allowed.
- Use restrictions: No time-shares, no subdivision of units without Board approval, no mineral exploration, no visible animal housing structures, no temporary structures as residence. All uses must be lawful and comply with local zoning; any nuisance or unlawful activity is prohibited. Leases must bind tenants to all condominium documents, and owners are liable for tenant violations.
