Spanish View is a standard single-family home subdivision in Scottsdale, AZ, governed by a Declaration of Restrictions (CC&Rs) that run with the land. The rules apply to all lot owners and residents, covering what you can build, how you use the property, and basic upkeep standards. This is a traditional subdivision covenant, not a condominium or master-planned HOA with associations fees or common-area maintenance.
- Land use & building type: Each lot is limited to one detached single-family dwelling, no taller than 2½ stories, plus a private two-car garage. No business, hospital, or manufacturing is allowed. Lots cannot be resubdivided into smaller parcels.
- Architectural review: All construction plans (including additions and alterations) must be approved in writing by the Architectural Control Committee for quality, design harmony, and location. Approval is automatic if the committee does not respond within 30 days of submission and no lawsuit is filed before construction is complete.
- Setbacks & lot lines: Houses must be at least 20 feet from the front property line, 25 feet from the rear, and 7 feet from interior side lot lines (with a total side-yard aggregate of 14 feet between facing dwellings). Next to a street, side setbacks are 10 feet (with a 7-foot opposite side). Garages and other buildings cannot be built until the main dwelling is under construction.
- Fences & walls: Rear-yard fences or walls cannot exceed 6 feet. Front or side-street setbacks: max height 2 feet 6 inches. Side-lot-line fences/walls can be up to 6 feet. All fence designs need Architectural Control Committee approval.
- Pets & animals: No animals, livestock, birds, or poultry may be raised or kept. Personal household pets (dogs, cats, etc.) are allowed but must be fenced or leashed at all times and cannot become a public nuisance.
- Vehicles & parking: No inoperable or abandoned vehicles may be stored visible from other lots or streets. No overnight parking of trucks, pickup trucks, or trailers in the street. Only passenger cars and pickup trucks may be parked in open carports or driveways. Boats, trailers, and equipment cannot be parked in the front area without Architectural Control approval.
- Property maintenance & nuisances: Lots must be kept free of rubbish, weeds, and litter; lawns and grounds must be neat and planted. No noxious or offensive activities. Trash must be in sanitary containers. During prolonged absence, the owner must arrange for care. Six neighbors may clean up a neglected lot and file a lien for costs if the owner refuses to pay within 30 days.
- Term & amendment: These covenants run with the land for 30 years from recording (approx. through 2010) and automatically renew for successive 10-year periods unless a majority of lot owners vote to amend or revoke via a recorded document.
