The Heritage Scottsdale (aka Scottsdale Marquesa) is a condominium community in Scottsdale, AZ. This document is a 2006 amendment to the governing Declaration, clarifying definitions, architectural review rules, and insurance coverage. It binds all unit owners and the association.
- What you own & maintain: The association insures only ‘bare walls’ (structure, common elements). Owners must insure floorcoverings, wall coverings, cabinetry, built-in appliances, electrical/plumbing fixtures, and HVAC inside or outside the unit. The association’s policy excludes mold damage; owners bear that risk.
- Architectural review: Major alterations (e.g., moving walls, electrical, plumbing, HVAC, sprinkler relocation) require prior written approval from the Architectural Committee and the Board of Directors, plus City of Scottsdale permits where noted. Minor alterations like paint, flooring, cabinets, countertops, appliances inside the unit do not require committee approval unless they involve patios, windows, exterior doors, exterior painting, water valve changes, or window coverings.
- Unfinished Ceiling & airspace: The airspace above the unfinished ceiling (5/8" drywall on furring strips) and between load-carrying trusses is general common element. Modifications (electrical, plumbing, ductwork, sprinkler alterations) require prior written approval from the Architectural Committee and the Board of Directors.
- Structural alterations: Any structural alteration, addition, or improvement to general common elements requires approval by 51% of the membership and a licensed professional engineer with $5,000,000 minimum errors and omissions insurance.
- Insurance deductibles & losses: The Board has sole authority to decide who pays the deductible if a loss occurs. If an owner must pay the deductible, it is due within 60 days; unpaid amounts are collectible like delinquent assessments.
