What Dune Shadow's governing documents say
This is a shared well agreement among property owners in the Dune Shadow area (Stanfield, AZ), not a full homeowners association governing document. It establishes rights and responsibilities for a domestic water well serving multiple parcels, primarily setting rules for water use, cost-sharing, and maintenance of the well.
- Water rights & ownership: Each owner has an ownership interest in the well based on a minimum 10% per acre of land owned. Each owner may use water for normal domestic purposes and must take reasonable precautions to conserve water. No owner may use water until their share of expenses is paid.
- Allowed buildings served by well: Only single-family dwellings, guest homes, barns, shops, garages, or similar buildings may be serviced by the well, and only with the express written consent of all owners.
- Well fund & annual contributions: Owners contribute annually to the Dune Shadow Well Association No. 2. The initial annual contribution is $375. Thereafter the amount is set by a majority interest of owners. Funds cover maintenance, repairs, electricity, and other well-related expenses. Deficits are contributed by owners in equal shares.
- Additional well construction: Any owner may construct an additional well on their parcel at their own expense, provided it complies with all laws, no more than two residences are served on any parcel, and the new well does not impair the existing well's ability to meet demand.
- Transfer of rights: When an owner sells a parcel, the transferee automatically assumes the same rights and responsibilities under this agreement. Well rights cannot be transferred separately from the property.
- What this document doesn't cover: This document governs only the shared well and water rights. It does not establish any homeowners association, architectural restrictions, leasing rules, pet policies, or common area maintenance beyond the well. Other community rules, if any, would be found in separate documents.
