Pampas Grass Well Co-Op is a private water cooperative in Stanfield, AZ. Property owners within the designated parcel (Parcel #501-08-050) automatically become shareholders with one share per single-family residence. The co-op operates a shared well and distributes water to shareholders for domestic use. This document is the co-op's bylaws, governing water usage, fees, maintenance, and member obligations.
- Shares & Membership: Each single-family residence in the co-op gets one share that passes with the land. Shares cannot be sold or transferred separately. Each share has one vote, and a simple majority carries decisions.
- Voting & Meetings: Annual business meetings are held each January; special meetings may be called as needed. Votes can be cast in person or by written proxy. No elected officers; a caretaker and an alternate are selected by rotation to oversee operations and collect fees.
- Fees & Payment: Monthly water fee is $18 per residence, billed quarterly in advance. Non-participating shareholders (those not drawing water) pay $9 per month until they attach a fixture. Delinquent payments 60 days in arrears may be turned over to small claims court, and water can be shut off until all owed amounts plus three months of advance payments (in certified funds) are deposited.
- Water Usage Restrictions: Water is for bonafide domestic purposes only. Filling pools over 2,000 gallons requires outside water at the owner's expense. Sprinkler use is limited to lawn areas not exceeding 500 square feet; individual plant/tree watering is allowed. Flood irrigation is prohibited. Any new or additional uses must be approved by a majority vote. Shareholders must make reasonable efforts to conserve water.
- Maintenance & Repairs: Each shareholder is responsible for their own water service line and plumbing, and for repairing damage caused by them or their guests. Water lines in established easements are the co-op's responsibility, except damage caused by the owner or their contractor. Repairs to the system costing over $50 require majority consent, and if repairs exceed the well account balance, the overage is divided equally among shareholders.
- Easements & Testing: The co-op has established easements for all system elements to ensure access for operation, maintenance, and testing. The co-op is responsible for annual testing of the well water.
- Non-Participating Shareholders: Shareholders who have not drawn water pay a reduced fee of $9 per month. Once they attach any fixture (hose bib or residence), they begin paying the full $18 monthly service fee.
- Sewage Setback: No element of an individual sewage disposal system may be located or relocated within 100 feet of the well.
