What Robson Ranch Carefree Villas's governing documents say
This is a tract declaration establishing the Carefree Villas Association within the master-planned Robson Ranch community in Stanfield, AZ. It applies to owners of attached villas (Lots 1-51) and supplements the larger Robson Ranch Master Declaration. Owners belong to both the master association and this sub-association, which handles landscaping, exterior maintenance, and common areas.
- What you own & maintain: You own the interior of your villa and are responsible for structural repairs, HVAC, and interior improvements. The Carefree Villas Association maintains the roof, exterior surfaces (paint, glass), driveways, walkways, and all landscaping (front, side, back yards) including irrigation. You cannot alter exterior landscaping or paint without approval.
- Architectural review: Any exterior change (building, fence, satellite dish, landscaping, paint, roof replacement) requires prior written approval from the association or Declarant. Plans must be submitted showing color, materials, and location; a reasonable review fee may be charged. Approvals consider harmony with surrounding structures and the community's uniform appearance.
- Assessments & fees: Annual assessments are set by the board each year, paid monthly. The maximum annual assessment started at $105/month in 2013 and can increase by up to 10% per year (compounded). Special assessments may also be levied. Delinquent assessments incur an 18% annual interest and a late fee up to 25% of the unpaid amount, and are secured by a lien on the lot.
- Association membership & voting: Each lot gets one membership with one vote (but Declarant gets three votes per lot until the transition date). Until the Carefree Villas Transition Date, Declarant controls the board and can appoint directors. Owners' voting rights are suspended if assessments are delinquent or for infractions (up to 60 days). Cumulative voting is allowed in board elections.
- Use of common areas: All owners have a nonexclusive easement to use the Carefree Villas Areas (common tracts), subject to association rules. The association can suspend use rights for delinquent assessments or rule violations (up to 60 days), and may limit access to certain areas. The association can also mortgage or transfer these areas.
- Insurance: The association must maintain property insurance on common areas and lots (excluding owners' interior improvements), commercial general liability (at least $1M per occurrence), and workers' comp if required. Owners are advised to carry their own insurance for interior surfaces, cabinetry, personal property, and liability. Association insurance is primary; owners waive subrogation against the association for covered losses.
