5th Street Condominiums is a 22-unit condominium community in Tempe, AZ. You own your individual unit (apartment + patio) and share ownership of the common elements, which the association maintains and insures. The declaration establishes the rules for use, maintenance, and governance.
- What you own & maintain: You own the interior of your unit (including air conditioning, heating, and interior fixtures), while the association maintains the common elements (land, exterior walls, roof, walkways, parking areas, etc.). The unit owner is responsible for all interior surfaces, plumbing, electrical, and floor coverings.
- Leasing & rentals: Leases for less than 30 days are prohibited (no transient/hotel use). You may only lease the entire unit, and the lease must include a provision that the tenant complies with all condominium documents. No other restrictions on leasing.
- Pets: Customarily accepted household pets are allowed in numbers and according to rules set by the board. No animals may be kept for commercial purposes.
- Parking & vehicles: Each unit owner has the exclusive right to use at least one assigned parking space. No boats, campers, or recreational vehicles may be parked on the property. Passenger vehicles and motorcycles are allowed; vehicle repairs require board approval.
- Architectural review: No exterior alterations, additions, or improvements visible from outside are allowed without board approval. This includes awnings, screens, window coverings (except inside drapes), and landscaping. Structural changes to a unit require board approval and an engineer's certification.
- Assessments & voting: Each unit pays an equal share (1/22nd) of common expenses. Initial maximum monthly assessment was $50 per unit, adjustable annually by cost-of-living increase. Special assessments require 2/3 vote of owners. Each unit has one vote; the declarant initially held 22 Class B memberships with 3 votes each, converting to Class A upon sale.
