Dave Brown Bell Road is a single-family residential community in Tempe, Arizona — you own your individual lot and dwelling, which must meet strict architectural standards enforced by an Architectural Control Committee. The Association maintains common areas (Tracts A-F), funded by per-lot assessments.
- What you own & maintain: You own your lot and single-family dwelling; the Association owns and maintains the common areas (Tracts A-F), funded by per-lot assessments.
- Single-family residential use only: Only one detached single-family dwelling per lot, maximum two stories, with attached garage. Prohibited: mobile homes, trailers, apartments, and any business or commercial use.
- Architectural review & approval required: Before erecting, modifying, adding to, or repainting any building, structure, or improvement, you must submit plans to the Architectural Control Committee for prior written approval. The Committee's judgment is final. Variances may be granted at the Committee's discretion; requests are deemed disapproved if not approved within 60 days.
- Parking & vehicles: Motor vehicles must be concealed in a garage or approved enclosure, except passenger cars, vans, motorcycles, and pickup trucks 3/4 ton or less (in daily use with current license plates). RVs, trailers, boats, and other vehicles must be concealed. Vehicles may not remain parked in driveways for more than one week without written approval.
- Landscaping & Front Yard: Front yards must be landscaped within 120 days of purchase with at least one tree (24-inch box) and ground cover. Front hedges limited to 3 feet; side and rear fences limited to 6 feet (masonry only). Must comply with City of Chandler requirements.
- Lot maintenance: Grass and weeds must be kept cut; lots maintained neatly. Clotheslines must not be visible from other lots. Trash in covered containers stored out of public view. No dumping or storage except during active construction.
- Assessments, working capital fund & transfer fees: Annual assessments are levied uniformly per lot and may increase by the Consumer Price Index or 5% yearly (larger increases require 2/3 member vote). Buyers must pay 1/6 of the annual assessment as a nonrefundable working capital fund at purchase, plus a Board-set transfer fee. Delinquent assessments accrue 12% annual interest plus late charges up to 18%.
- Pets & animals: A reasonable number of house or yard pets allowed, subject to local zoning. Pets must be leashed when outside fenced areas and must not create noise or nuisance. No animal structures visible from neighboring property.
