Sunset Shadows Unit Two is a subdivision of single-family residential lots in Tempe, AZ, governed by a Declaration of Restrictions recorded in 1981. These restrictions run with the land and apply to all lot owners, requiring homes to meet minimum size and approval standards, and limit certain uses. There is no ongoing homeowners association; only an architectural committee until all lots are built.
- What you own & maintain: You own your lot and the single-family home you build on it. No outbuilding may be used as a residence. The lot must be used only for residential purposes, with a private garage or carport for up to two cars.
- Minimum home size: Every dwelling must have a ground-floor area of at least 1,100 square feet, excluding open porches, pergolas, or attached garage.
- Architectural review: All construction plans must be approved in writing by a three-member Architectural Control Committee appointed by a majority of property owners. Two of three members may approve. The committee automatically dissolves once all lots are built upon.
- Construction timeline: Construction must be completed within six months from the date of the building permit, as determined by final inspection from the City of Tempe.
- Use restrictions: No commercial animal husbandry or livestock is allowed. Utility easements as shown on the recorded plat must remain free of structures or plantings that could interfere with utilities.
- Duration & amendment: These restrictions run until June 1, 2002, and automatically renew for successive 10-year periods unless a majority of lot owners vote to change them in whole or in part.
