Tempe Santa Fe Palms Townhomes is a planned residential community of townhomes in Tempe, AZ. You own your lot and dwelling, and share responsibility for common areas (pool, spa, landscaping, private streets, gates) through a homeowners association. All owners and residents must follow the rules in this Declaration, which runs with the land.
- What you own & maintain: You own the fee simple to your lot and the residential dwelling on it. The association maintains the common area (including pool, spa, landscaping, private streets, gates) and exterior of dwellings. You must maintain your lot and dwelling in good repair, and can be fined for neglect.
- Architectural review: Any exterior alteration visible from neighboring property requires prior written approval from the Board (or Architectural Committee). The Board has broad discretion based on aesthetics and can disapprove even if the plans comply with rules. Decisions are final. Fees may apply.
- Leasing & rentals: Leases must be in writing, for a term of at least 30 days. No short-term or vacation rentals. All tenants must comply with the rules. A transfer fee may be due upon lease execution.
- Pets: Only common household pets (dogs, cats, birds, etc.) are allowed, kept as domestic pets not for commercial purposes. The Board may later limit size/number, but existing pets are grandfathered. Pets must be leashed (max 6 feet) and cleaned up after; no nuisance.
- Parking & vehicles: Vehicles must be parked inside the garage whenever possible. On-street parking is prohibited except for temporary loading/unloading (max 24 hours). Guest parking is available in designated common area spaces. Commercial vehicles, RVs, boats, and trailers are not allowed unless parked in garage and not visible.
- Home businesses: Home businesses are allowed only if not detectable from outside the dwelling, do not generate extra traffic or parking, and involve no more than one non-resident employee. The Board determines compliance.
- Use restrictions: Each dwelling must be used as a single-family residence. No nuisances, no exterior speakers, no antennas without approval (except FCC-protected dishes), no clotheslines visible from neighboring property, no garage sales except community-wide ones coordinated by the Board.
