What Appaloosa Meadows's governing documents say
Appaloosa Meadows is a single-family home subdivision (HOA) in the Village of Oak Creek (Big Park), AZ. The Declaration of Covenants, Conditions, and Restrictions (CC&Rs) applies to all lot owners. Homes must be site-built, single-family dwellings with at least 1,500 square feet of living area, a two-car garage or carport, and completed within one year of construction start.
- Minimum home size & construction standards: Each home must be a 'Site Built Home' (no manufactured or prefab) with at least 1,500 sq ft of interior living area (excluding garages, carports, porches). Maximum two stories (35 feet); specific lots limited to one story. Construction must be completed within one year of commencement.
- Architectural review & exterior changes: Any exterior alteration, construction, fence, antenna, or color change requires prior written approval from the Architectural Review Committee (or Board). Plans are automatically approved if not acted on within 45 days of complete submission. Fines up to $5,000 may apply for violations.
- Landscaping & maintenance: Front yard landscaping must be completed within 6 months of home completion; corner lots also require side yard landscaping. Owners must keep lots free of excessive vegetation, trash, and unsightly items. The Association may enforce maintenance standards.
- Vehicles & parking: Trucks over one ton, boats, campers, and similar vehicles must be screened from neighboring properties. Recreational vehicles and travel trailers may be parked without screening if not unsightly. No overnight street parking. Only vehicles in operating condition with current registration may be parked on the property. Garages and carports must be used for parking and storage, not living space.
- Animals & pets: On lots under 1.5 acres, only domestic household pets (reasonable number) allowed; chickens, goats, pigs, cattle prohibited. On lots 1.5 acres or more, up to 4 horses/ponies allowed with restrictions. No animals may become a nuisance. Pets must be leashed (max 6 ft) when off the owner's lot.
- Leasing & rentals: Owners may lease their dwelling. All leases must be in writing and include a requirement for tenants to follow the governing documents. Leases must be for at least one month (short-term/vacation rentals effectively prohibited). Owner must provide tenant and pet information to the Association.
- Assessments & fees: Annual assessments are levied per lot. The Association may also levy special assessments. Failure to pay can result in a lien and foreclosure. Late charges, interest, and attorney's fees may be added. Transfer fees may be charged upon sale.
- Enforcement & fines: The Board may impose reimbursement assessments of up to $200 per violation (after notice and hearing). Unpaid assessments collectible like regular assessments. The Board may also impose fines up to $5,000 for architectural violations.
