What Sun City Az HOA Bylaws's governing documents say
This is the corporate bylaws of the Recreation Centers of Sun City, Inc. (RCSC), a nonprofit that operates recreational facilities in the age-restricted (55+) community of Sun City, Arizona. All property owners in Sun City must sign a Facilities Agreement and pay assessments to RCSC, which governs membership privileges, fees, and use of the community's amenities. These bylaws define who qualifies as a Member, how the Board is elected, and the rules for residents who are not owners.
- Age restriction (55+): At least one occupant of each property must be 55 years or older. A spouse under 55 but at least 19 may be a Member if the other spouse is 55+. Non-owner residents (renters) must also have an occupant 55+ and no one under 19 to obtain a Privilege Card.
- Membership & privileges: Property owners who are 55+ and occupy the property as their primary Arizona residence (or live within 75 miles) can become Members. Members in good standing may vote, serve on the Board, use all RCSC facilities, join clubs, and receive discounts. Non-owners and owners under 55 can purchase Privilege Cards for limited access but cannot vote or hold office.
- Assessments & fees: All property owners must pay an Annual Property Assessment (per property or per person for pre-2003 owners). Transfer fees include a Preservation and Improvement Fee (PIF) and Capital Improvement Fee (CIF) when ownership changes. Fees are determined by the Board and are a continuing lien on the property.
- Non-owner residents: Renters, tenants, and other non-owners may purchase a 30-, 60-, 90-day, or annual Privilege Card if at least one occupant is 55+ and no one is under 19. Privilege Cardholders can use facilities and join clubs but cannot vote or serve on the Board.
- Board & elections: The Board consists of nine Directors elected by Members. Directors serve staggered terms up to three years (max six years total). Annual election in December. Candidates must be 55+, Members in good standing, and reside in Sun City at least 10 months per year.
- Petitions & amendments: Members may propose amendments to the Bylaws or Articles via petition (10% of Members). The Board also can amend Bylaws with a two-thirds vote at two meetings. Recall elections for Directors require a majority of votes cast (min 100 votes).
