What Morgan Pointe Homeowners Association Inc's governing documents say
Morgan Pointe is a planned community of detached single-family homes in Angier, NC, governed by a homeowners association (HOA). This declaration sets out the rules and obligations for property owners, including assessments, architectural review, and use of common areas. It is relevant to current and prospective homeowners, as well as renters, since leases must comply with the declaration.
- What you own & maintain: You own your lot and home; the HOA maintains common areas, including stormwater facilities, greenway trails, private roads, and entry signage. Owners are responsible for maintaining their own property and any common area easements on their lot.
- Assessments & fees: Annual assessments are capped at $800 per lot until 2024, with increases limited to 10% per year unless approved by two-thirds of owners. A one-time working capital fee of $700 is due at every sale closing. Special assessments up to $700 per lot may be levied in emergencies, and unpaid assessments become a lien on the property.
- Leasing & rentals: Leases must be for at least 12 months, in writing, and include a clause binding tenants to the HOA rules. Owners who rent out their home cannot use common facilities while the tenant occupies the home as their principal residence.
- Architectural review: Any exterior changes, including buildings, fences, signs, or major landscaping, require written approval from the Declarant (or later the HOA) before starting. Approval is deemed given if no response within 30 days.
- Common area use & restrictions: Owners and their families, tenants, and guests may use common areas, but the HOA can suspend use for unpaid assessments (after 30 days) or rule violations (up to 60 days). No one may remove trees, erect structures, or alter common areas without permission.
- Voting & membership: Each lot gets one vote, but owners of rented or vacant homes have their vote capped at 49% on any matter. The developer retains control until 2031 or until no lots are owned by the developer, whichever comes first.
- Easements & access: Utility, drainage, and sight-distance easements exist across lots; owners must keep sight lines clear between 2 and 8 feet. The HOA and utility companies have rights to enter lots for maintenance and repairs.
- What this document doesn't cover: This excerpt does not include details on pet restrictions, parking rules, or specific architectural guidelines—those may be in separate rules or bylaws.
