Match Point Village is a townhome community in Cary, NC, governed by a homeowners association (HOA). The rules bind all lot owners, who are automatically members of both the Match Point Village Townhomes Association and the Kildaire Farms master association. This document is the declaration of covenants, conditions, and restrictions, which is the primary rulebook for the community.
- What you own & maintain: You own your townhome lot, but the association provides exterior maintenance for most of the outside of your home, including roofs, gutters, exterior surfaces, and front-yard landscaping. You are responsible for maintaining your rear yard if you fence it in, and you may not plant in the front yard without written approval.
- Assessments & fees: The annual assessment is capped at $420 per lot initially, and can increase up to 10% per year without a vote. Special assessments for capital improvements require a two-thirds vote of each class of members. Assessments are uniform for all lots, and unpaid assessments accrue interest at 10% per year and can become a lien on your property.
- Architectural review: You must get written approval from the association's board (and the Kildaire Farms board) before making any exterior changes, such as building a fence, adding a structure, or altering the exterior. If they don't respond within 30 days, approval is deemed given.
- Parking & vehicles: Each lot is entitled to one parking space plus at least one additional space. Boats, trailers, campers, and recreational vehicles are not allowed in limited common areas, greenways, or rights-of-way; they must be parked only in designated areas.
- Party walls: Walls shared between townhomes are party walls, and repair costs are shared proportionally by the owners who use them. Disputes about party walls are settled by arbitration.
- Insurance & reconstruction: The association carries master casualty and liability insurance on the buildings and common areas. If a casualty occurs, the association is responsible for rebuilding, and if insurance proceeds are insufficient, it can levy special assessments without a member vote.
