Brittany Towne is a condominium community in Pinehurst, NC, established in 1975 under the North Carolina Unit Ownership Act. It consists of 14 units in two two-story buildings, with each unit owning an undivided 7.143% interest in the common areas. This document is the original declaration plus a 1982 amendment that removed Pinehurst, Inc.'s right of first refusal but kept a right of first refusal for the Board of Administrators.
- What you own & maintain: You own the interior space of your unit, including interior walls, fixtures, and finished surfaces, plus patios and front/rear entrances. The association owns and maintains common areas like roofs, main walls, foundations, walks, parking, and utility lines.
- Right of first refusal on resale: Before selling, you must offer the unit to the Board of Administrators at the same price and terms as the highest bona fide offer. The Board has 20 days to decide and another 20 days to close. Gifts to spouse, parents, or lineal descendants are exempt.
- Mortgage restrictions: You may mortgage your unit without Board approval only for a first or second mortgage from a bank, life insurance company, savings and loan, or similar lender to finance the purchase. Other mortgages require Board approval, and all mortgages must give the Board notice of default and at least 10 days' notice before foreclosure.
- Use & occupancy: Units must be used only as private dwellings for the owner, family, tenants, and social guests. No immoral, improper, offensive, or unlawful use is allowed.
- Alterations & approvals: No improvements, alterations, or changes to the exterior of buildings or common areas are allowed without written consent from the Declarants (until all units sold) and the Association.
- Common expenses & assessments: Each unit pays common expenses in proportion to its 7.143% undivided interest. Owners cannot exempt themselves from paying by waiving use of common areas or abandoning their unit.
- Amendments: The Declaration can only be amended or revoked with the agreement of 66 2/3% of unit owners, and no amendment can affect a valid mortgage lien.
