What Shadow Creek Owners Association Inc's governing documents say
Shadow Creek is a planned community of detached single-family homes in Cary, NC, governed by a homeowners association (HOA). This declaration establishes the HOA, its voting structure, and the rules for property use, maintenance, and assessments. It applies to all current and future homeowners in the community.
- What you own & maintain: You own your lot and home; the association maintains common areas, including stormwater facilities, street trees, and landscaped islands. Owners are responsible for maintaining any common area easements on their lot, and the association can enter to maintain them and charge the owner.
- Assessments & fees: Annual assessments are $1,140 per Class A lot until Dec 31, 2020 (may change with budget approval). A one-time working capital contribution of $750 is due at initial sale. Special assessments require a 2/3 vote of Class A members, and individual special assessments can be levied for damage or rule violations.
- Voting & membership: Each lot owner gets one vote per lot, but the developer (Declarant) gets 9 votes per lot it owns until the Declarant Control Period ends (no later than Dec 31, 2040). Owners of vacant or leased homes have their votes capped at 49% weight on any matter.
- Leasing & rentals: The declaration does not restrict leasing, but owners who lease their home lose full voting weight (capped at 49%). Tenants may use common areas as their principal residence.
- Common area use & restrictions: Owners have an easement to use common areas, but the association can charge fees, suspend use for unpaid assessments (30+ days) or rule violations (up to 60 days), and can dedicate or transfer common areas with 80% member approval. Owners cannot remove trees, erect structures, or alter common areas without permission.
- Architectural review: The declaration references architectural design guidelines and allows the board to enforce them, including imposing fines and assessments for violations. Specific design rules are not in this document.
- What this document doesn't cover: This excerpt does not include the full architectural guidelines, rules and regulations, or details on amenities (if any). It also doesn't specify pet rules, parking, or rental restrictions beyond the voting provision.
