Chadsford is a planned community of detached single-family homes in Durham, NC, governed by a homeowners association (HOA). This declaration sets out the rules and obligations for all lot owners, including assessments, use of common areas, leasing, and architectural controls. It is the full rulebook for the community.
- What you own & maintain: You own your lot and home outright; the association maintains the common areas (e.g., stormwater ponds, drainage easements) and carries liability and hazard insurance on common property. You must maintain any common-area easement on your lot, and the association can enter your property to maintain it.
- Assessments & fees: Annual assessments are set by the board, with a maximum that started at $300 per lot in 2005 and can increase up to 10% per year without owner vote; larger increases need a 2/3 vote. Special assessments for capital improvements also require a 2/3 vote. Unpaid assessments accrue interest at 18% per year and become a lien on the property.
- Leasing & rentals: Leases must be in writing, for at least six months, and must include a clause binding the tenant to the declaration and association rules. If the owner doesn't include it, the clause is automatically deemed part of the lease. Leased properties have limited voting weight (max 49% on any matter).
- Architectural review: Before making exterior changes (buildings, fences, signs, major landscaping), you must submit plans to the Declarant (or later the architectural committee) for written approval. If no response within 30 days, approval is deemed given. A processing fee up to $125 may be charged.
- Common area use & restrictions: Owners and their families, tenants, and guests have a right to use the common areas, subject to association rules. The association can suspend use rights for unpaid assessments (after 30 days) or for rule violations (up to 60 days). You cannot remove trees, erect structures, or alter common areas without permission.
- Fines & enforcement: The association can fine owners for rule violations: up to $75 per day for a first violation, $100 per day for a second, and $150 per day for subsequent violations. Fines become a lien on the property. The association can also use self-help (e.g., towing vehicles) to cure violations.
- Voting & governance: Each lot gets one vote, but the Declarant had 10 votes per lot during the control period (until 2010 or earlier). Leased properties have limited voting weight. The declaration can be amended with 80% owner approval during the first 25 years, then 75%.
