What Woodcreek Homeowners Association Inc's governing documents say
This is a declaration of covenants, conditions, and restrictions for Woodcreek, a single-family residential subdivision in Durham, NC, with three phases. It binds all lot owners and prospective purchasers, and it establishes a homeowners association (Woodcreek Homeowners' Association, Inc.) to maintain common areas and enforce the rules.
- Land use & building type: Each lot is for one single-family dwelling only; no other structures (e.g., shops, hospitals) are allowed. During development, the declarant may maintain a model home, but not after completion.
- Architectural review: Before erecting or altering any structure (house, fence, driveway, flagpole, exterior lighting), plans must be submitted to and approved in writing by the Review Committee. The committee responds within 30 days and cannot unreasonably withhold approval. Rebuilding a destroyed building on the same location per original plans does not require approval.
- Common area maintenance & assessments: The association maintains common areas (grass, shrubs, trees, irrigation) and carries liability insurance and pays taxes on them. Each lot owner pays a pro rata share of these costs via assessments; unpaid assessments become a lien, subordinate to first mortgages.
- Lot maintenance & use: Owners must prevent erosion, keep their lot neat and free of trash, cut/water grass, maintain trees/shrubs/flowers, and maintain their driveway. The association and declarant reserve easements for utilities, drainage, and common area maintenance.
- Parking & vehicles: No vehicle, boat, or trailer may be parked on any street overnight. Inoperative, wrecked, or junked vehicles without current plates/registration must be removed within 30 days.
- Pets & livestock: No livestock or poultry may be raised or kept. Up to two household pets (dogs, cats, etc.) are allowed, but they cannot be kept for commercial purposes.
- Signs & temporary structures: No signs are allowed except one 'for sale/rent' sign up to 5 square feet and builder signs during construction. Temporary structures (trailers, tents, shacks, barns) require prior written approval from the Review Committee.
- What this document doesn't cover: This is the declaration of covenants, not the full set of association rules or bylaws. It does not specify assessment amounts, pet size/breed restrictions, or details about the association's internal governance beyond membership and voting.
