What Pineywood Townes's governing documents say
Pineywood Townes is a townhome community in Durham, NC, where you own your unit and share common areas with other owners. It is part of the larger Woodlake subdivision, so you also belong to the Woodlake Homeowners Association and pay assessments to both associations. The Pineywood Townes HOA handles exterior maintenance of your home and common areas, while Woodlake maintains private streets and provides amenities like a clubhouse and lake.
- What you own & maintain: You own your townhome and the land it sits on, plus a private garage and auto pad. The Pineywood Townes HOA maintains the exterior of your home (paint, roof, gutters, etc.) and common areas, but you are responsible for interior maintenance, glass, screens, awnings, and any approved additions.
- Assessments & fees: You pay annual and special assessments to the Pineywood Townes HOA, and also assessments to the Woodlake HOA. The initial maximum annual assessment was $792 per lot ($66/month), and it can increase up to 10% per year without a vote; larger increases require a two-thirds vote. Unpaid assessments accrue interest at 18% per year and can become a lien on your property.
- Leasing & rentals: The document does not restrict leasing or rentals, but you may delegate your common area rights to tenants. No minimum lease term is stated.
- Pets: You may keep dogs or cats as pets, but they must be kept indoors and not become a nuisance. No other animals, livestock, or poultry are allowed, and no commercial animal keeping is permitted.
- Architectural review: Before making any exterior changes or building structures, you must submit plans to the Pineywood Townes HOA board or architectural committee for approval. If they don't respond within 30 days, approval is deemed given. You also need approval from the Woodlake HOA.
- Parking & vehicles: You have exclusive use of your private garage and auto pad. The HOA can regulate parking in common areas and may prohibit parking of motorcycles, campers, boats, and trailers. No campers, boats, or trailers may be parked in any street right-of-way. Garage doors must be kept closed when not in use, and garages cannot be converted to living space or used for storage that prevents parking a car.
- Use restrictions: Properties must be used only for residential purposes. No obnoxious or offensive activities are allowed. Garbage containers must be screened or kept in garages. Dwellings must have at least 1,200 square feet (one-story) or 1,400 square feet (multi-story) of main structure.
- Party walls: Walls shared between townhomes are party walls. Repair and maintenance costs are shared proportionally by the owners who use the wall. If a wall is destroyed, any owner may restore it, and others who use it must contribute. Disputes are resolved by arbitration.
