What Wynstead at Hvf's governing documents say
This is the declaration of covenants, conditions, and restrictions for Wynstead at Hope Valley Farms, a planned community of single-family homes in Durham, NC, created under the North Carolina Planned Community Act. It establishes a homeowners association (HOA) that all lot owners automatically join, and it sets out the rules for use, maintenance, architecture, and finances that apply to every owner and resident.
- What you own & maintain: You own your lot and the home on it, and you are responsible for maintaining your lot, landscaping, and exterior of your home. The association maintains common areas, streets, entry features, and stormwater systems.
- Occupancy & use: Lots are for residential use only. All occupants of a lot must be a single housekeeping unit: a family plus no more than two unrelated persons. Home businesses are allowed only if ancillary to residential use and compliant with rules.
- Leasing & rentals: The association may require a minimum lease term of six months and may otherwise regulate leasing, but it cannot prohibit leasing or require approval to lease or transfer a lot.
- Architectural review: No exterior changes, fences, landscaping, or other improvements may be made without prior written approval from the Declarant (while it controls) or the architectural review committee. Approval is based on aesthetics and can be withheld in the reviewer's sole discretion. Construction must be completed within 12 months of commencement.
- Parking & vehicles: Only licensed, operative passenger cars, station wagons, pick-up trucks, and passenger vans may be regularly parked in driveways. No regular parking on roadways. Recreational vehicles must be screened from view, and no vehicle may be used as a dwelling.
- Pets & outdoor items: Boats, campers, satellite dishes, clotheslines, and pet enclosures must not be visible from any roadway or other lot. Trash must be stored in screened, covered receptacles out of view.
- Assessments & finances: The association levies annual assessments to fund common expenses, with a budget prepared at least 60 days before each fiscal year. After the Declarant control period ends, annual base assessments cannot increase by more than 20% from the prior year. Special assessments may be levied for repairs or other needs.
- What this document doesn't cover: This excerpt does not include the initial Rules and Regulations (Exhibit C), the Architectural Guidelines, or the Bylaws, which are incorporated by reference and contain additional day-to-day rules. It also does not state the current assessment amount or any specific fees.
