What Arbor Greene Homeowners Association Inc's governing documents say
Arbor Greene is a single-family home HOA subdivision in Apex, NC (Wake County). This declaration of covenants, conditions, and restrictions (CC&Rs) governs the community and binds all lot owners, covering assessments, maintenance, architectural control, and land-use restrictions.
- Assessments & fees: Annual assessments are set by the Board and can increase up to 10% per year without a member vote; larger increases require a 2/3 vote of each class. Special assessments for capital improvements also require a 2/3 vote. At closing, buyers pay a sum equal to two months' assessments into reserves (non-refundable).
- What you own & maintain: You own your lot and detached single-family home. The HOA maintains common areas (including private streets, open space, buffer areas, and amenities) and can step in to maintain your lot if you don't, billing you for the cost.
- Architectural review: Any exterior construction, alteration, or addition (including fences, sheds, painting) requires prior written approval from the Declarant or the HOA. Approval is deemed given if no response within 60 days of submission.
- Land use & restrictions: Lots are for residential use only, with one detached single-family dwelling per lot. Temporary structures (trailers, tents, metal storage buildings) are prohibited. No commercial activity, no burning trash, and no noxious activities.
- Pets & animals: Dogs, cats, and other household pets are allowed, but not for commercial breeding or keeping. Outdoor pets must be in a fenced rear yard.
- Parking & vehicles: Unlicensed or disabled vehicles must be parked in an enclosed garage. Boats, trailers, and campers must be in an enclosed garage or on approved parking pads in side/rear yards.
- Fences & buffer areas: Fences require approval and are generally allowed in rear/side yards, but not in buffer areas (which must remain natural) unless approved by the HOA and Town of Apex.
- Signs & satellite dishes: Only one 'for sale/rent' sign (max 5 sq ft) and owner/street number signs are allowed. Satellite dishes and outdoor clotheslines require written approval.
