This is a supplement to the Enchanted Oaks HOA declarations, annexing the Hickory Leaf Reserve neighborhood into the master-planned Enchanted Oaks community. It creates a sub-association (Hickory Leaf Reserve HOA) for the new single-family homes, with its own assessments and rules, while remaining under the master association. This document is for homeowners and prospective buyers in Hickory Leaf Reserve, as it establishes their obligations and the community's governance structure.
- Community structure: Hickory Leaf Reserve is a new single-family home neighborhood within the larger Enchanted Oaks master-planned community. It has its own sub-association (Hickory Leaf Reserve HOA) that manages common areas and assessments, while the Enchanted Oaks HOA remains the master association.
- Assessments & fees: All owners must pay annual assessments, special assessments, and a one-time working capital assessment (at least two months of the annual assessment) at closing. Assessments are uniform per lot, and unpaid assessments become a lien on the property, with interest up to 18% per year and foreclosure possible.
- Voting & membership: Each lot gets one vote in the sub-association, but the developer (Hickory Leaf Ranch, LLC) holds three votes per lot until 2035 or until 75% of lots are sold, and can appoint the board until then. Owners can vote by proxy, and a 10% quorum is required for meetings.
- Developer control: The developer retains significant control until December 31, 2035, or until 75% of lots are conveyed, including the right to appoint the board and approve amendments. The developer is exempt from paying assessments on its own lots for one year after the first lot sale.
- Amendment & duration: The covenants run for 35 years from recording (2015), then auto-renew for 10-year periods unless 80% of owners vote to end them. Amendments require a 66 2/3% vote of all members, but the developer's consent is needed until 2035.
- Common property & maintenance: The sub-association maintains common property (open space, stormwater areas) and can levy assessments for maintenance, insurance, and improvements. Owners are responsible for their own lots and homes.
