What Mccullers Walk Master Owners Association Inc's governing documents say
This is the declaration of covenants, conditions, and restrictions for The Townes at McCullers Walk, a townhome community within the larger McCullers Walk master-planned development in Garner, NC. It governs the townhome owners' association and applies to anyone who owns a townhome lot in this sub-community. It works alongside the master declaration for the entire McCullers Walk community.
- What you own & maintain: You own your townhome lot and its interior. The association maintains common areas, exterior building surfaces, roofs, gutters, landscaping (except inside fenced areas), and streets/sidewalks. You are responsible for interior maintenance, fenced yards, and any damage from casualty, negligence, or acts of God.
- Leasing & rentals: Leases must be in writing, for at least six months, and subject to the declaration and association rules. The association can require copies of leases and tenant/vehicle information.
- Assessments & fees: Annual assessments start at $960 per lot per year, can increase up to 10% annually without a vote, and higher increases need 2/3 member approval. Special assessments for capital improvements also require 2/3 approval. A one-time $150 working capital contribution is due at first conveyance. Late fees are $20/month plus 8% interest.
- Architectural review: Any exterior improvements or alterations require written approval from the architectural committee under the master declaration. The declarant can grant blanket approvals to builders.
- Party walls: Shared walls between townhomes are party walls. Repair and maintenance costs are shared proportionally by the owners who use the wall, and owners have rights of entry for repairs.
- Use restrictions: The townhome lots are subject to the use restrictions in the master declaration, which are incorporated by reference. The association can enforce those restrictions.
- What this document doesn't cover: This document does not include the full use restrictions (they are in the master declaration), nor does it cover rules about pets, parking, or age restrictions. It also doesn't specify the exact amenities or common areas.
