It binds the association and all property owners to comply with Raleigh's city code, and it supplements the community's main declaration and bylaws. This document is not a full rulebook—it focuses on city-mandated obligations like open space, tree conservation, insurance, and utility maintenance.
- What this document covers: This is a supplemental covenant required by the City of Raleigh, not a complete set of HOA rules. It imposes city-code obligations on the association and owners, and it will be paired with a separate declaration and bylaws that contain the day-to-day rules.
- Common elements & maintenance: The association is responsible for maintaining common elements, including landscape easements, private streets, and private utility lines serving more than one lot. Owners have a non-exclusive easement to use common elements for access and enjoyment.
- Tree conservation & open space: Permanently protected undisturbed open space and tree conservation areas are protected: no land-disturbing activity or tree removal without a city permit. The association holds a conservation easement over tree conservation areas.
- Insurance: The association must carry hazard insurance on common elements and liability insurance of at least $1,000,000, with premiums paid as common expenses.
- Private streets & utilities: Private streets and water/sewer lines serving more than one lot are owned and maintained by the association. If the association fails to maintain them, the city may do the work and charge owners, with liens and late fees for nonpayment.
- Parking & sight triangles: Any parking restrictions on public streets apply only to owners, their family, and tenants. Sight triangles must be kept clear of obstructions between 2 and 8 feet tall.
- Access easements: Owners have a perpetual easement to access adjoining lots for repairs if their home is within 5 feet of the lot line, and government agencies have a right of access for public safety and utility work.
