What Providence of Raleigh Townhouse Owners Association Inc's governing documents say
This is a first amendment to the governing declarations for Providence of Raleigh, a planned community in Raleigh, NC, with a separate townhouse sub-association. It amends the original rules for both the master community and the Phase 2 townhouses, so it's relevant to homeowners in either area. The amendment updates specific rules about building materials, setbacks, fences, and assessment timing.
- What this document covers: This is an amendment to the existing declarations, not a full rulebook. It changes specific rules about siding, side yard setbacks, fence height and materials, and when developer/builder assessments are due.
- Building materials: Vinyl siding is now an approved building material, removing a previous ban.
- Setbacks: Side yard setbacks now follow the Raleigh City Code, which may change from time to time.
- Fences: Fences can now be up to six feet tall (previously five feet), and wooden fences are no longer banned. The Architectural Review Board (or Declarant) approves fences on a case-by-case basis.
- Assessments for builders/declarant: Annual assessments for the Declarant and builders can accrue monthly and become due only at closing—when the Declarant sells to a builder, or when a builder sells a completed home to an owner-occupant. During the Declarant Control Period, the Declarant must cover any operating deficit.
- Declarant's amendment rights: The Declarant can amend the declarations without owner approval during the Class B membership period if the change reasonably relates to development or marketing rights.
- What this document doesn't cover: This amendment does not restate the full rules for the community. For complete rules on pets, leasing, parking, or other typical HOA topics, you'd need to read the original Master Declaration and the Phase 2 Townhouse Declaration.
