What Dutchman Creek Homeowners Association Inc's governing documents say
Dutchman Creek is a single-family home subdivision in Raleigh, NC, governed by a homeowners association (HOA). This document is the amended master declaration of covenants, conditions, and restrictions that applies to all lots in the subdivision. It outlines the HOA's structure, assessments, architectural controls, and use restrictions that all homeowners must follow.
- HOA membership & voting: Every lot owner is a member of the HOA. Each single-family lot gets one vote, but the developer (Declarant) has three votes per lot until December 31, 2009, after which all votes become equal.
- Assessments & fees: The HOA can levy annual and special assessments. The maximum annual assessment started at $240 in 2003 and increases by 5% each year. Special assessments require approval by 51% of votes cast at a meeting. A one-time working capital fee equal to one-fourth of the annual assessment is due at the first transfer of a lot.
- Architectural review: Any exterior changes—including buildings, fences, pools, sheds, or changes in grade—must be approved in writing by the Architectural Review Committee before starting. Plans must be submitted, and if the committee doesn't act within 30 days, approval is presumed. Trampolines are prohibited.
- Use restrictions: Homes must be used as residences only. No signs (except small real estate or contractor signs), no house trailers, no exposed above-ground tanks, and no outdoor clotheslines visible from the street. Home occupations are allowed only if they don't increase traffic or parking significantly.
- Leasing & rentals: Leases must be for at least 60 days, and tenants must agree to follow the HOA rules. No hotel or transient use is allowed.
- Parking & vehicles: Street parking is allowed only temporarily (up to 72 hours). Inoperable or unregistered vehicles must be kept in an enclosed garage. Boats, trailers, and campers must be stored out of view from streets.
- Pets & animals: Livestock and poultry are not allowed without written HOA permission. A 'reasonable number' of household pets is allowed, as determined by the HOA board.
- What this document doesn't cover: This is the master declaration; it doesn't include specific rules for individual sub-neighborhoods (which may be in supplemental declarations) or the HOA's bylaws. It also doesn't list current fee amounts or specific pet limits.
