What Raven Pointe Homeowners Association Inc's governing documents say
Raven Pointe is a single-family home HOA in Raleigh, NC, governed by a Declaration of Protective Covenants. This document sets out the rules for homeowners, including assessments, maintenance responsibilities, and use restrictions. It also covers leasing, pets, vehicles, and architectural review.
- What you own & maintain: Owners are responsible for their lot and dwelling, including doors, windows, fixtures, decks, and any landscaping they install. The association maintains common areas, entry features, street lights, storm water facilities, and the exterior of townhome dwellings (if any), including roofing surfaces and landscaping originally installed by the developer.
- Assessments & fees: The association levies annual assessments, which may be paid in installments, plus special assessments (requiring 2/3 owner vote) and specific assessments for expenses benefiting only some lots. Unpaid assessments accrue late charges, interest (up to 12% per annum), and become a lien on the property. The board sets the budget, and owners can disapprove it by majority vote.
- Leasing & rentals: Lots may be leased for residential purposes, but leases must have a minimum term of six months. Leases must require tenants to acknowledge and comply with the Declaration, Bylaws, and rules, and the board may evict tenants on behalf of owners for noncompliance.
- Pets: Only dogs, cats, or other usual household pets in reasonable numbers (as determined by the board) are allowed. Pets must be leashed when outside, registered and vaccinated, and cannot be kept for commercial purposes. Pets that cause damage, make objectionable noise, or constitute a nuisance must be removed upon board request.
- Parking & vehicles: Vehicles must be parked in designated parking areas (garage or driveway). Boats, RVs, trailers, and unlicensed or inoperable vehicles cannot be left on the community for more than five days unless stored in a garage or approved area. Garage doors must be kept closed except during ingress/egress.
- Architectural review: Any exterior construction, alteration, or addition requires prior written approval from the Architectural Review Committee. This includes fences, sheds, pools, exterior color changes, antennas, satellite dishes, and tree removal (trees over 4 inches in diameter or any dogwood). The committee has 60 days to respond, and approval can be withheld for any reason, including aesthetics.
- Use restrictions: Lots are for residential use only; no businesses without board approval. No firearms, no window air conditioning units, no exterior clotheslines, no swimming pools, and no overhead utility lines. Garbage cans and woodpiles must be screened from view. Fences require approval and generally must be cedar, with height limits.
- What this document doesn't cover: This excerpt does not include the full text of the Declaration (e.g., sections on insurance, condemnation, annexation, mortgagee provisions, easements, general provisions, recreational facilities, variances, litigation, and capitalization are referenced but not fully provided). It also does not include the Bylaws or any separate rules and regulations.
