This is the bylaws document for the 10 Arros Condominium Owners Association, a condominium community in Raleigh, NC. - Membership & voting: Every unit owner is a member. Each unit gets one vote, and there are 10 total votes in the community. Annual meetings are held in May; special meetings can be called by the board or by 20% of the votes. A quorum for special meetings is 6 votes.
- Board of directors: The association is managed by a 3-person board elected at the annual meeting. The declarant initially appoints directors and can control the board until certain ownership thresholds are met. Directors can be removed by a 67% vote of the membership.
- Assessments & budget: The board proposes an annual budget, which is ratified unless rejected by more than 51% of the votes. If rejected, the previous budget continues. Assessments are collected as stated in the Declaration.
- Fines & enforcement: The board can fine a unit owner up to $150 per violation of the rules. The owner has a right to a hearing before an Adjudicatory Panel, which can confirm, deny, or modify the fine.
- Meetings & notice: Members must receive written notice 14 to 30 days before a meeting. The notice must include the agenda. Proxies are allowed and are valid for one year unless a shorter term is specified.
- Amendments: Owners can amend the bylaws with a 60% vote, but the declarant's consent is needed while it controls the board. The board can make minor amendments without owner approval. Amendments that materially affect mortgagees require approval from 51% of mortgagees.
