Windy Hills is a single-family home subdivision in Wilmington, NC, governed by a 1961 Declaration of Restrictions that runs with the land. These covenants apply to all lot owners and are designed to maintain a uniform residential character.
- Residential use only: Lots may be used only for residential purposes, except Lots A, B, 3, 7, and 12, which may also be used for streets. No commercial activity is allowed.
- Single-family homes & minimum size: Only one detached single-family dwelling (max two stories) and a two-car garage per lot. Every dwelling must have at least 1,000 square feet of floor space.
- Architectural approval: Plans and designs for any building must be submitted to developer J.H. Hobbs (or his nominee) for written approval to maintain uniform design, size, type, cost, and appearance.
- Setback requirements: On most lots, buildings must be at least 40 feet from the front street line and 10 feet from side lines (7.5 feet on Lots 18, 19, 20). On Lots A, B, 2, 21–31, setbacks are determined by the developer.
- Pets & livestock: No hogs, cattle, sheep, goats, horses, poultry, or other livestock. Dogs, cats, and other household pets are allowed but not for commercial breeding or keeping.
- Temporary structures & trailers: No trailer, tent, shack, or temporary structure may be used as a residence. Living quarters for servants above a garage are allowed once the main building is complete.
- Canal use & boat size: A private canal is for the sole use of lot owners. Boats are limited to 18 feet in length and 5 feet in width.
- Duration & amendment: These covenants run for 10 years from 1961, automatically renewing for successive 10-year periods unless a majority of lot owners record a change.
