This document is a collection policy for the Hunters Creek Homeowners Association in Frisco, TX — a single-family home community. It is an ancillary document that supplements the community's Declaration of Covenants, Conditions and Restrictions (CC&Rs) and outlines the association's procedures for collecting delinquent assessments. It does not contain the full rules of the community (e.g., architectural standards, pet policies, or use restrictions), which are in the main CC&Rs.
- Assessments & due dates: Annual assessments are due on the first day of the month. Special assessments are due as determined by the Board. If not paid by the 30th day after the due date, the assessment becomes delinquent.
- Delinquency & late fees: After the delinquency date, the Association sends a Late Notice. A Default Letter is sent no sooner than 60 days after the due date. A $25 fee plus bank charges applies to dishonored checks. Interest, late charges, and collection costs (including attorney's fees) are added to the delinquent amount.
- Collection process & foreclosure: If not cured within 45 days of the Default Letter, the delinquency may be referred to legal counsel. The Association may record a Notice of Lien, and if not paid within 20 days, may foreclose via expedited or judicial foreclosure. The Association may bid on the property at foreclosure and pursue a deficiency judgment.
- Notice requirements: Notices are sent to the owner at the address on record with the Association. If an owner has a representative or agent, notices to that representative are effective.
- What this document doesn't cover: This document is only the Association's collection policy. It does not include the community's full CC&Rs, such as architectural guidelines, pet restrictions, leasing rules, or other homeowner obligations. Those are found in the main governing documents referenced in the supplemental certificate.
