Lakeview Estates is a single-family homeowners association (HOA) community in Anna, TX. This document is a collection of guidelines the HOA has adopted to comply with Texas state law; it supplements the main CC&Rs. The guidelines cover religious displays, security measures, swimming pool enclosures, architectural review processes, violation hearings, and bidding procedures, but do not include many common HOA rules such as assessments, pets, leasing, or parking.
- Religious item display: Owners may display religious items on their property, but cannot threaten public health or safety, violate laws, display patently offensive content, or install items on common property, rights-of-way, or utility fixtures. State law overrides conflicting HOA rules.
- Security measures: Owners may install security cameras only on their own property. All perimeter fencing must comply with existing CC&R restrictions on size, height, color, and material, and requires prior architectural approval.
- Swimming pool enclosures: Owners may install a pool enclosure that is black, made of transparent mesh in metal frames, and meets safety requirements. Other enclosures must follow CC&R restrictions and get prior approval.
- Architectural review: Architectural review authority cannot include current board members, their spouses, or household members. Denials must include a detailed basis and notice of the right to appeal to the board within 30 days; the board must hold a hearing within 30 days of the request.
- Violation hearings: Before certain violation hearings, the HOA must provide the owner with a packet of documents and communications at least 10 days prior. If not provided, the owner gets an automatic 15-day postponement.
- Solicitation of bids: For service contracts over $50,000, the board must solicit at least three bids (if reasonably available), unless an emergency or other defined exigent circumstance exists. The board is not required to pick the lowest bid.
