Bay Springs (Arlington) is a standard single-family homeowners association in Arlington, TX. This document is the HOA's Assessment Collection Policy — a board-adopted procedure for collecting dues, late fees, and other charges, not the full set of community rules. It applies to all homeowners (lot owners) in the association.
- Assessments & due dates: Regular assessments are due on the first calendar day of each month (the exact frequency is not specified in this document). Special assessments may be payable in installments; if an owner defaults on an installment, the association can accelerate the entire balance after 15 days' notice.
- Late fees & collection costs: A $30 fee applies for returned checks. The defaulting owner is liable for all collection costs, including attorney fees, certified mail charges, long-distance calls, filing fees, and other reasonable expenses. Late fees and interest can only be waived by a majority of the board.
- Payment plans: The association must offer a payment plan of up to 18 months from the date requested, with administrative costs and interest. If an owner defaults on the plan, remaining amounts are accelerated and applied per the policy's payment hierarchy.
- Suspension of amenities: The board may suspend an owner's (or tenant's) use of common area amenities if the owner's account is delinquent for at least 30 days.
