Burgundy Hill 1 is a single-family home subdivision in Arlington, TX, governed by a Declaration of Covenants recorded in 1976. These covenants apply to all lot owners and are enforceable by any property owner in the subdivision. The rules define what you can build, how you maintain your property, and basic land-use restrictions.
- What you own & maintain: You own your lot and detached single-family home. You must keep grass and vegetation mowed; if you don’t, the Architectural Control Committee can have it done and bill you, with a lien on the lot.
- Construction & completion: Every structure must be completed within 8 months of starting construction. No building may be occupied until connected to the city sewage system. All residences must have at least 1,400 sq ft of living area and be no more than two stories.
- Architectural review: Before erecting, placing, or altering any structure on your lot, you must submit plans and a plot plan to the Architectural Control Committee for approval. Approval is based on workmanship, materials, harmony with existing structures, and location. The Committee can waive restrictions. Failure to decide within 45 days after submission (or if construction starts before approval) means approval is deemed given.
- Exterior finishes & fences: First-floor exterior walls must be at least 75% masonry, stone, or brick unless the Committee approves otherwise. Roofs other than wood shingles require approval. Boundary fences can be masonry, hedge, or wood up to 6 ft high; must not be nearer the front street than the front wall of the residence. Corner lots have side-street building line restrictions.
- Pets & animals: No livestock, poultry, or animals other than the usual and ordinary household pets are allowed.
- Signs & businesses: Signs are prohibited except one 3x5 ft rental or sale sign. Engaging in a trade or business on the lot is prohibited, as is any activity that becomes an annoyance or nuisance.
- Garbage & storage: Trash, ashes, and garbage must be kept in covered containers and removed by the city’s garbage service. Burning or dumping on lots is forbidden. No building materials or temporary structures (like mobile homes) may be stored on the property until the owner is ready to begin construction.
- Term & renewal: These covenants run for 30 years from the recording date (April 1976) and automatically renew for successive 10‑year periods unless owners of two‑thirds of the lots agree to change them.
