The Colonnade is a single-family home community in Arlington, TX, governed by a homeowners association (HOA). These rules bind all owners and residents. The community consists of 17 lots, and the HOA maintains common areas and enforces restrictions.
- Leasing & rentals: Leases must be for at least 12 consecutive months; short-term rentals (less than 12 months) are prohibited. Leases must be in writing, cover the entire unit, and prohibit tenant subleasing. After an early termination, no new lease is allowed for 12 months unless waived by the Board. Owners must provide the Board with a copy of the lease and tenant contact info.
- Signs: No signs visible from public view without prior written architectural approval, except for one 'for sale' sign (max 5 sq ft) and one ground-mounted political sign (max 2x2 ft). Signs offering to lease or rent a living unit are expressly prohibited.
- Use restrictions: Lots must be used for single-family residential purposes only. No trade, business, commercial use, boarding house, hotel/motel, or private clubs. Transient or vacation rentals are explicitly prohibited.
- Architectural review: Any building, fence, wall, or exterior alteration requires prior written approval from the Architectural Control Committee. Plans must be submitted showing design, materials, and location. The committee has 30 days to approve or disapprove. Minimum living unit floor area is 2,200 sq ft. At least 75% of first-floor exterior walls must be stone, masonry, brick, or glass building material.
- Assessments & fees: The HOA levies semi-annual assessments (initially capped at $300 per year per living unit) to cover maintenance of common areas, insurance, and services. Special assessments for capital improvements require 2/3 member vote. Assessments can increase annually per the Consumer Price Index or by a 2/3 vote. Delinquent assessments bear 10% annual interest and become a lien on the property.
- Sight & visibility easement (Lot 4): On Lot 4, no fence, wall, hedge, or shrub taller than 3 feet may be constructed, except a wrought iron fence identical to the existing golf course fence. Trees on the easement may remain if foliage is kept high enough to not obstruct sight lines from Lot 3.
- Mineral rights: No surface disturbance for oil, gas, or mineral exploration/development is allowed. Owners may lease or sell their mineral rights, but only subject to these restrictions.
