This is a Declaration of Covenants, Conditions, Restrictions & Bylaws for the Landmark the Timbers HOA, a single-family home community in Burleson, TX (also referred to as Hidden Vistas III-R). It governs all owners of platted lots within the development. The HOA maintains common areas (entry monuments, landscaping, roads, playground) and enforces architectural standards, land use, and assessment rules.
- What you own & maintain: Each lot has a single-family detached home (max 2½ stories) with an enclosed garage (min 2-car). Owners maintain their home and lot; the HOA maintains common areas like entry monuments, landscaping, irrigation, roads, drainage, and a playground. The association has the right to borrow and may convey common areas with 2/3 owner approval.
- Architectural review: No exterior improvements (houses, fences, driveways, etc.) may be constructed without prior written approval from the Architectural Control Committee. Plans must be submitted at least 14 days in advance. The committee also issues Design Guidelines and may grant deviations. Minimum air-conditioned floor areas vary by lot (e.g., Landmark: 2,800–3,000 sq ft; Timbers: 1,900–2,200 sq ft). Exterior walls must be at least 95% masonry (brick, stone, stucco) except possibly in Timbers. Wood fences may be allowed case-by-case; chain link prohibited. Fences must be 4–6 ft tall, with perimeter fences 6 ft.
- Assessments & fees: Annual assessment starts at $500 per lot and can increase up to 10% per year without owner vote; any higher increase requires 66⅔% member approval. Special assessments also require 66⅔% vote. A transfer fee of $150 is due from the purchaser at each lot sale. Delinquent assessments accrue 18% interest and may lead to lien foreclosure, suspension of common area use, and voting rights suspension. Association lien is subordinate to first mortgages.
- Parking & vehicles: Vehicles must be parked so not visible from adjoining lots, except temporary guest parking. No overnight street parking. Trucks over ¾ ton and commercial vehicles with signage cannot repetitively park overnight. Inoperable vehicles without current plates/inspection must be stored in an enclosed garage. RVs allowed only if stored in a garage or approved structure. No flammable cargo vehicles.
- Pets: No more than four (4) household pets (dogs, cats, etc.) permitted per home. No commercial breeding or food animals. Pets must be restrained within the home or a securely fenced rear yard; owners must keep the lot clean and free of waste. Consistently barking dogs may be considered a nuisance.
- Land use & restrictions: Lots are for single-family residential use only. No business activities apparent from outside the home (no client visitation, no door-to-door solicitation). Temporary dwellings, mobile homes, and tents prohibited. No above-ground pools. Clothes drying outdoors is forbidden. Satellite dishes limited to 24 inches; antennas must not exceed roof ridge height. No signs except a 5-sq-ft real estate sign, builder signs, and political signs (max 5 sq ft, removed 5 days after election).
- Membership & voting rights: Each lot owner is a Class A member with one vote per lot. Declarant (developer) is a Class B member with 10 votes per lot until such time as Class B votes are less than Class A, or 15 years from recording, or declarant chooses to convert. Owners must be in good standing (no delinquent assessments or deed restriction violations) to vote or hold office.
