What Ws Water Homeowners''s governing documents say
This document governs the WS Water Homeowners’ Association, a single-family residential subdivision in Tarrant County, Texas, but it focuses primarily on the shared underground water system (wells, pumps, pipelines) that serves the lots. Standard HOA topics like pets, parking, and landscaping are not addressed; instead, the rules control any construction or activity that could affect the water system, require architectural committee approval for water-system‑related improvements, and impose assessments to fund water system upkeep. Water rights and system maintenance are the core purpose of this association.
- Water system use & maintenance: No owner may alter, repair, or perform work on any component of the water system without prior written board approval. The association is responsible for maintenance, repairs, and replacement of the water system, funded by assessments. Owners cannot interfere with other owners' access to groundwater.
- Assessments: Regular annual assessments are initially set at $75 per month per lot, due in monthly installments beginning May 1, 2020. The board may adjust assessments annually. Special assessments require approval of at least two‑thirds of members present at a meeting with a quorum of 50% (or 30% at a second meeting). Unpaid assessments accrue 10% annual interest and become a lien on the lot.
- Architectural review (water system only): An Architectural Committee reviews plans and specifications for any improvement that could affect the water system, directly or indirectly. Approval is required before construction; the committee may disapprove any proposed improvement that might impair the water system. A variance can be granted if the water system is not harmed.
- Subdivision of lots: A lot may be subdivided into smaller parcels, but the subdivided portion will only receive water from the system if the Architectural Committee gives prior written consent. The owner is responsible for any fees associated with the committee's review.
- Hazardous activities & drainage: No activity or improvement may be conducted or constructed that is hazardous to or affects any owner's right to receive groundwater. Owners must not alter drainage patterns that could impact the water system.
- Removal from association: Any lot may be removed and released from this declaration by an amendment approved by at least 67% of votes. A removed lot loses membership rights, access to the water system, and is no longer subject to covenants or assessments.
- Enforcement & penalties: The board may impose fines, cure violations and charge the owner, seek injunctive relief, and foreclose assessment liens (subject to notice to lienholders). Owners are liable for damage to the water system caused by their guests or occupants.
