What Crows Nest's governing documents say
Crows Nest is a condominium community in Dallas, TX, established in 1977 with 40 units in 7 buildings. Owners own their unit individually and share ownership and maintenance of common elements through the CROW'S NEST, INC. association. This document is the original full declaration of condominium and contains rules about use, rentals, assessments, and a right of first refusal. It does not cover pet restrictions or age limits.
- What you own & maintain: You own your unit in fee simple and an undivided percentage interest in the common elements. The association maintains the general common elements; you maintain everything inside your unit, including windows, air-conditioning, and interior finishes.
- Leasing & rentals: Rentals for less than 30 days are prohibited (no transient/hotel use). Owners may rent for residential purposes for 30 days or more, but the association has a right of first refusal to match any proposed lease (30-day notice required; 75% vote by owners needed to exercise).
- Right of first refusal: Before selling, renting, or leasing your unit (unless you are the developer), you must give the board 30 days’ written notice with the offer details. The association can then match the offer, but only if 75% of owners vote to exercise.
- Use restrictions: Units are for residential single-family use only. No business, professional, or commercial activity, and no subdivision into more than one dwelling unit per unit.
- Assessments & liens: Each owner pays a pro-rata share of common expenses based on a fixed percentage (ranging from 1.4% to 3.2%). Unpaid assessments become a lien on the unit, superior to most other liens except property taxes and prior recorded mortgages.
- Limited common elements: Balconies/patios (except units 13,14,27,28) and designated carports/garages are limited common elements reserved for the exclusive use of the adjacent unit owner.
- Alterations & improvements: No structural modifications or substantial alterations to your unit without following the bylaws. Changes to common elements require written approval from the board or council.
- Insurance & reconstruction: The association carries property insurance on buildings and common elements; you insure your own contents and personal liability. If more than two-thirds of buildings are destroyed, reconstruction is not compulsory unless all owners agree.
