Quail Creek is a standard single-family subdivision in Arlington, TX, governed by restrictive covenants recorded by the developer. These rules run with the land and apply to all homeowners, requiring homes of at least 1,000 square feet with 65% masonry exteriors, limiting pets to domestic companions (no horses, cows, or poultry), and setting a maximum fence height of 8 feet. No homeowners' association or regular fees are established; the developer's architectural control ended in 2010, and now any architectural approval requires a majority vote of lot owners to appoint representatives.
- Building & design standards: Each home must have a minimum gross living area of 1,000 square feet (excluding garages, porches, etc.). At least 65% of exterior wall area (excluding windows and doors) must be brick, stone, or other masonry on the first story. Plans and plot plans must be approved in writing by the developer (or later by a majority-elected committee); if no response within 30 days or if no lawsuit is filed before completion, approval is deemed given.
- Occupancy & single-family use: Only one private dwelling per lot, occupied by a single family, plus a servant house and necessary outbuildings. No temporary structures (trailers, tents, etc.) may be used as residences except sales/construction trailers during the marketing period.
- Pets & animals: Domestic animals are allowed only as companions (no commercial use). Specifically prohibited on lots: horses, cows, hogs, sheep, goats, guinea fowl, ducks, chickens, turkeys, or any animal that interferes with quietude, health, or safety.
- Fencing & setbacks: No fence may extend nearer to any street than the front building line. Maximum fence height is 8 feet (or city requirement, whichever is less). Within the 50-foot Mobil Pipeline Easement, no fencing is allowed without written approval from the pipeline company.
- Industrial & nuisance prohibitions: No oil drilling, mining, or quarrying. No noxious trades, nuisances, or dumping of trash (must use sanitary containers and keep incinerators clean).
- Architectural review & enforcement: Before constructing or altering any building, plans must be approved in writing by the developer (or its representatives) for external design harmony. The developer's power ended January 1, 2010; thereafter, no approval is required unless a majority of lot owners execute a recorded instrument appointing a replacement committee. Violations may be enforced by any property owner via legal action for damages or injunction.
