This is a declaration annexing a new unit (Unit 27) to the Robson Ranch Denton Resort Community, a master-planned 55+ active-adult community in Denton, TX. It applies to homeowners in that unit, who are automatically members of both the master HOA and the Robson Ranch Villas Association No. 1. The document sets out the rules for the villas, including maintenance responsibilities, assessments, and architectural controls.
- Community type & membership: Robson Ranch is a master-planned, age-restricted (55+) community. Owners of villas in Unit 27 are members of both the master Robson Ranch Denton HOA and the Robson Ranch Villas Association No. 1, and must pay assessments to both.
- What you own & maintain: You own your villa lot and the home on it, but the Villas Association handles all exterior maintenance: landscaping (including sprinklers), roofs, exterior walls, glass, driveways, and walkways. You cannot alter the exterior or landscaping without written approval, and you give up control over the outside appearance.
- Assessments & fees: Annual Villas Assessments are set by the board and paid monthly. For 2015 the cap was $275/month, increasing by up to 10% per year (or as allowed by law). You also owe separate assessments to the master HOA. Late payments incur a late charge up to 25% of the delinquent amount and 18% annual interest, and can become a lien on your property.
- Architectural review: Any exterior change—fences, paint, landscaping, solar collectors, etc.—requires prior written approval from the Villas Board or Declarant, and a review fee may be charged. The board can reject plans that don't harmonize with the community.
- Developer control & transition: Until the 'Villas Transition Date' (which may be delayed indefinitely if the developer keeps lots for rental or marketing), the developer retains absolute control over the Villas Association, including the right to appoint the board and amend governing documents. Homeowner voting rights are limited until then.
- Warranty & dispute resolution: New homes come with a 10-year express limited warranty from the developer, and all other implied warranties are disclaimed (limited to 1 year). Disputes under the warranty go to binding arbitration.
