This is a covenant enforcement and fine policy for The Hills of Argyle, a single-family homeowners association in Argyle, Texas. It tells homeowners how the HOA detects, notifies, and fines them for rule violations. This is an ancillary policy document, not the full community rulebook; the actual restrictions (like architectural standards, leasing rules, etc.) are in the Declaration and other governing documents.
- Fine structure: For curable violations, the initial fine is $500, the second fine is $750, the third fine is $1,000, and subsequent daily fines are $100 each. Uncurable violations or ones posing a health/safety threat can be fined up to $2,000. The board can adjust amounts based on severity and frequency.
- Notice & cure process: Violations typically start with a courtesy notice giving 14 days to cure. If not cured, a formal Notice of Violation is sent, and you have 14 more days to fix it before fines begin. Work on unapproved improvements must stop immediately.
- Right to a hearing: Within 30 days of a Notice of Violation, you can request a hearing before the board. The board must hold the hearing within 30 days of your request, and you get an evidence packet 10 days beforehand. You may attend or send a representative.
- Corrective action (self-help): If you don't cure a violation after notice, the HOA may hire contractors to fix the problem and bill you for the cost, plus any fines. They must give you prior written notice of corrective action and a chance to cure.
- Common violations: Examples include unapproved storage (boats, vehicles, trailers), leaving trash cans out on non-pickup days, unapproved signs, unapproved exterior modifications, missing lawn maintenance, inoperable vehicles, parking violations, and others. The list is not exhaustive.
- Repeated violations: If you commit a similar violation within six months of a prior one, the HOA can reinstate previously waived fines and double the amount of new fines without further notice.
- Lien for unpaid fines: Failure to pay fines and costs may result in a lien on your property. You are personally responsible for all fines and enforcement costs, even if a tenant caused the violation.
