This document is a Restrictive Covenant and Agreement between a homeowner and the builder (Sandlin Homes) for a single lot in Horse Shoe Hills, not a community-wide rulebook. It primarily governs dispute resolution, warranties, and maintenance responsibilities for the specific property. It does not create an HOA or impose community-wide restrictions.
- Dispute resolution: mediation & arbitration: Any dispute (including construction defects, personal injury, property damage) must first go to mediation; if unresolved, to binding arbitration under the Federal Arbitration Act. Owner and builder waive jury trial, and waive remedies of specific performance, rescission, and recovery of professional fees.
- Warranty & construction defects: Builder provides a limited warranty (specimen required). Owner waives any implied warranties, including good and workmanlike construction. During the first 5 years, if repair cost for a builder-responsible defect exceeds 30% of fair market value, builder may elect to repurchase the property under Texas Property Code §27.0042.
- Mold & maintenance: Builder disclaims any warranty regarding mold or biological impurities. Owner is responsible for maintenance (humidity control, prompt leak repair, cleaning) to prevent mold. Builder includes recommendations for ventilation, cleaning, and inspection.
- Insurance & subrogation: Owner must maintain property insurance. Both parties waive subrogation rights against each other. Owner indemnifies builder if a third party (e.g., subrogee) asserts claims related to a dispute.
- Binding on successors & recorded: This agreement is recorded in the county real property records and binds the owner's successors and assigns.
- What this document doesn't cover: This document does not create an HOA, impose architectural controls, limit leasing, regulate pets or parking, or set age restrictions. It is a builder-focused contract for this lot only.
