Bonita Oaks Estates is a single-family residential subdivision (Lakeside, TX) governed by recorded restrictive covenants that run with the land. These rules bind all lot owners and are enforced by an Architectural Control Committee or later by a majority of lot owners. There is no active HOA with ongoing assessments; instead, each owner maintains their own lot and must comply with these deed restrictions.
- Architectural review: Before any construction or exterior change (building, fence, roof, paint color, landscaping), plans must be approved by an Architectural Control Committee. The committee ensures harmony of external design. If no decision within 30 days of submission, approval is deemed granted.
- Lot & building standards: Minimum lot size is 1 acre (43,560 sq ft). Minimum living area per residence is 2,000 sq ft (exclusive of porches, garages). Exterior walls must be at least 80% masonry (brick, stone, etc.). Minimum roof pitch is 8:12. Each home must have a two-car garage with side or rear entry.
- Setbacks & fences: Dwellings must be at least 30 feet from the front property line and 25 feet from side/rear lines. No fence closer to the street than the dwelling (except decorative fences). Fences require ACC approval, must be wood or masonry, and must be stained/painted. No barbed wire, chicken mesh, or hog wire.
- Use restrictions: Lots are for single-family residential use only. No manufactured homes, modular homes, mobile homes, trailers, tents, shacks, or temporary structures (except builder's facilities during construction). No above-ground swimming pools. No businesses, offensive trades, or nuisance activities. No firearms discharge (except for protection of life). Livestock, horses, goats, poultry are prohibited; cats and dogs are allowed but must be contained.
- Construction timeline: All exterior and interior construction (including electrical, plumbing, cabinetry, flooring) must be completed within one year of the date foundation forms are set.
- Maintenance & landscaping: Owners must keep the lot and buildings in clean, safe, and attractive condition, including lawn mowing, tree trimming, weed control, and repair of exteriors. Landscaping must be completed within 6 months of construction. No accumulation of trash; rubbish containers must be screened.
- Parking & vehicles: Boats, motor homes, sailboats, buses, and trailers must be parked at least 50 feet behind the front building line. No window or wall-type air conditioners are allowed (must be built-in). No exterior antennas or satellite dishes visible from the street without screening and ACC approval.
- What this document doesn't cover: This document is a set of deed restrictions, not an HOA governing document. It does not establish an association with mandatory membership, monthly dues, or common areas. It does not restrict leasing (other than prohibiting rentals that create a nuisance). There are no pet limits, no age restrictions, and no provisions for shared amenities.
