This is a Development Area Declaration for a specific tract (MFR Tract 1) within the larger Lakeside DFW master-planned community in Flower Mound, TX. It applies to multi-family residential rental apartments and supplements the community's Master Covenant. The rules bind owners and occupants of this tract, which is age-restricted (55+). Because this document covers only one development area, residents should also consult the master community rules for additional requirements.
- Age restriction (55+): Each apartment unit must have at least one occupant age 55 or older (an 'Age Qualified Occupant'). Exceptions: persons 19 or under may stay up to 90 days per year; surviving occupants after death of the age-qualified occupant; and any exception granted by the owner. At least 80% of all occupied units in the tract must have at least one age-qualified occupant. The owner must maintain age records and conduct surveys every two years.
- Pets: No more than two cats and dogs combined per apartment unit. Non-traditional pets (e.g., pot-bellied pigs, exotic snakes, monkeys) are prohibited. Pets must be leashed outside the unit or kept in a designated dog park; unattended pets in the park are not allowed. No kennels or breeding. Pet waste must be removed.
- Parking & vehicles: Inoperable vehicles, racing vehicles, commercial vehicles, recreational vehicles, boats, trailers, and stored vehicles are prohibited from being visible or parked on roadways within the development. Motorcycles must be operated quietly. Mobile homes are prohibited. Construction, service, and delivery vehicles are exempt during necessary periods.
- Signs & antennas: No signs visible to the public view without prior written approval, except for permits required by law and a religious item on the entry door or door frame (max 25 square inches total). Certain small antennas (≤1 meter) for satellite or broadcast signals are permitted, but must be located in the occupant's exclusive-use area (e.g., balcony) and not on exterior walls or roofs without written approval.
- Use restrictions & business activities: The development area must conform to zoning. Prohibited uses include tattoo parlors, fast food restaurants, pawn shops, sexually oriented businesses, auto repair, pet kennels, and many others. Home-based businesses are allowed only if limited to occupants, no signs, no door-to-door solicitation, and not detectable from outside the unit.
