- What this document covers: This is a partial record: a 2009 annexation adding 67 lots (Blocks A, B, C of Meadow Creek Phase II) to the existing Meadowcreek HOA, plus 2017 recorded policies on payment plans, document retention, payment application, and records copying fees. - Annexation & community expansion: The annexation makes the additional lots subject to the existing Meadowcreek Master Declaration, so those homeowners are bound by the same covenants, assessments, and association rules. The developer (Sumeer Homes) and builder (Harlan Properties) are exempt from assessments until all lots are developed and sold.
- Payment plans for delinquent assessments: If you owe assessments, you can request an alternative payment schedule. The minimum term is 3 months, maximum 18 months, and no extra penalties (beyond interest and admin costs) are charged during the plan. Owners who defaulted on a prior plan may be denied a new one for two years.
- How payments are applied: When you make a payment, the HOA applies it in a set order: first delinquent assessments, then current assessments, then attorney/collection fees, then fines, then other amounts. If you're in default on a payment plan, the order changes to prioritize attorney fees first.
- Records access & copying costs: Homeowners can request HOA books and records, but must pay copying and labor costs. Standard paper copies are $0.10 per page; labor is $15/hour (waived for requests of 50 pages or fewer); programming is $28.50/hour; overhead is 20% of labor; and other media (CDs, DVDs, etc.) have set fees. Advance payment is required.
- Document retention: The HOA must keep formation documents and covenants permanently, financial records and tax returns for 7 years, owner account records for 5 years, contracts over one year for 4 years after expiration, and meeting minutes for 7 years.
