PTCC Owners Association, Inc. Office Condominiums is a commercial office condominium community in Prosper, TX — you own your unit's interior and share ownership of the building's common elements. This binding declaration applies to all unit owners and occupants. The community is strictly for office, business, and professional use; residential, retail, or restaurant uses are prohibited.
- Use restrictions: Units may be used only for office, business, and professional purposes. Prohibited uses include residential, restaurant, retail, school, training, walk-in financial services, and any activity causing recurring noise, odor, fumes, or light visible from outside. No portion of any unit may be used for a bank, ATM, or similar.
- Leasing & rentals: Leases must be in writing, for a term of at least six months, and cannot be for transient or residential purposes. A unit cannot be subdivided to more than three tenants at a time. The owner must provide the association with a copy of the lease and tenant insurance/contact info.
- Animals: No animals of any kind (including dogs, cats, birds, fish, reptiles, insects) may be kept, maintained, raised, or bred anywhere on the property. Service or companion animals are not mentioned in this document; the association may have separate rules.
- Architectural review: Prior written board approval is required for any exterior alteration, including landscaping, fences, window treatments visible from outside, signs, equipment installation (e.g., AC units, security devices), and any change affecting drainage or structural integrity. Interior remodeling that does not alter exterior appearance or structural elements does not require approval.
- Parking & vehicles: All parking spaces are general common elements — no unit has reserved parking. Vehicles must be parked only in designated areas, cannot block streets or fire lanes, and overnight parking is prohibited unless approved by the board on a case-by-case basis. Inoperative or unregistered vehicles are not allowed.
- Assessments & fees: Each unit pays a uniform share of regular assessments based on the annual budget. Special assessments for major expenses require a majority vote. Late fees are at least $100 per late payment, and interest accrues at up to 18% per annum. The association can suspend services (except access) and may foreclose for nonpayment.
- Maintenance responsibilities: The association maintains all general common elements, including driveways, sidewalks, landscaping, porches, and the building's roof and exterior. The owner is responsible for maintaining the unit's interior, including all equipment serving only that unit (e.g., HVAC, water heater), and must keep appurtenant limited common elements neat. Emergency repairs by the association are charged to the owner.
